Who you are agreeing with

These terms are an agreement between you and Victor Martynov, an individual entrepreneur registered in Georgia («we»), about the Vímary app for iPhone and iPad and the website vimaryapp.com. By installing or using the app you accept them. If you do not, do not use the app.

What you get

We grant you a personal, non-transferable licence to use the app on Apple devices that you own or control, under the App Store’s rules. The app is for your own training. You may not copy, sell, rent, modify or reverse-engineer it, or extract its games, texts and artwork for another product.

Free part and subscription

All the games, the articles and two of the memory techniques are free, with a daily circle of two games. For a period after installing, shown in the app, everything is open.

The rest is unlocked by an auto-renewing subscription sold through the App Store: for a month, three months or a year, or a family year that covers you and up to four members of your Apple Family Sharing group. The price is shown in the App Store and in the app before you buy, in your local currency.

The subscription renews automatically at the end of each period unless you cancel at least twenty-four hours before it ends. Payment is charged to your Apple ID. You manage and cancel the subscription in your Apple ID settings; deleting the app does not cancel it. Refunds are handled by Apple under Apple’s rules, and you request them from Apple.

Your progress, records and the Path are never taken away: if the subscription ends, the circle becomes smaller, and everything you did stays.

What the app is and is not

Vímary is a trainer. It makes you better at its games and teaches memory techniques. It is not a medical device, does not diagnose or treat anything, and we make no promises about effects on your health, memory or intelligence outside the app. If you have a medical concern, see a doctor.

Your data

The app keeps your data on your device and sends nothing to us; the details are in the privacy policy. Keep your own backups: if you delete the app or lose the device, we cannot restore your progress, because we never had it.

Changes to the app and these terms

We improve the app, and games, techniques and features may change, be added or be removed. If we change these terms in a way that matters, the app or the App Store listing will say so, and the date at the top of this page will change. Continuing to use the app after that means you accept the new terms.

Warranty and liability

The app is provided «as is». To the extent the law allows, we do not guarantee that it will be free of errors or available at all times, and we are not liable for indirect losses from using it. Nothing here limits rights that consumer law in your country gives you and that cannot be waived.

Apple

The app is distributed through Apple’s App Store, and Apple’s standard terms for apps apply alongside these. Apple is not responsible for the app, for maintaining or supporting it, or for any claims about it; that is on us. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country under a U.S. embargo and not on any U.S. government list of prohibited parties.
